Terms & Conditions

OpheliaCOMPANY_LEGAL_NAME Effective EFFECTIVE_DATE

By contributing, buying, or commissioning, you agree to these terms. They are short on purpose.

1. The app is free

The Ophelia app costs nothing, shows no advertising, and is complete as it stands. Reading is free and always will be. Nothing in the app is locked behind a payment.

The books it reads are public-domain works fetched from third-party libraries. We do not own them and make no claim over them.

2. What is sold, and where

Purchases made on the website are for content used on the website. Themes inside the app are sold only through Google Play billing. We do not sell app themes on the website, and we do not sell web content through the app.

3. Web access lasts a week, and stacks

A contribution opens the paid pages on ophelia.epsilondevelopers.xyz for 7 days.

  • Contribute again and the time stacks: 7 days is added to whatever remains,

never replacing it. Nothing you paid for is ever discarded.

  • Your chamber never drops while your access is live. If you reach *A Letter

from the Wanderer*, you keep it — contact included — until the whole stacked period expires, even if later contributions are smaller.

  • When it expires, access simply closes. Contribute again and it reopens at the

chamber you had reached.

Downloads you have already taken are yours to keep. They do not expire.

4. Commissioned worlds

This section is the important one. It is repeated on the commission page, above the payment button, because you should not have to find it in fine print.

4.1 What you commission. You send a story. The maker builds a world by hand from it — its own light, its own type, its own weather.

4.2 What one commission buys. A commission is priced by size:

You commissionPriceWhat is built
One face$999A single face — its own light, type, weather and ritual
A whole world$1,999All three faces of one world: her two weathers, and him

You may revise and resend your story while your access is live; anything beyond what you commissioned requires a further commission. This is not a technical limit. Each face is weeks of one person's work.

4.3 The world is later sold as a theme. After it is delivered to you, your world is released into the app for everyone:

  • The open week. For 7 days everyone may use it, and during that week it

can be bought at half price.

  • After the week. It costs $4.99, the same as every other

commissioned face, and is locked for anyone who has not bought it — except that every reader may still take one free day inside it, once, whenever they like.

We do this because a commission does not cover the cost of building a world. Selling the theme afterwards is how that cost is recovered — and it is why the commission price is what it is rather than several times higher.

4.4 You receive 30% of net proceeds. For as long as your world sells, you receive 30% of the net developer proceeds it earns.

Net developer proceeds means the amount Google Play actually remits to us for that world's product, after Google's service fee, refunds, chargebacks, reversals, and taxes. It is what we receive, not what the buyer pays. Where a sale is refunded, the share on it is reversed.

  • Each world has its own Google Play product, so its sales are counted alone.
  • Statements and payments are quarterly.
  • Balances below PAYOUT_THRESHOLD roll forward to the next quarter rather

than being paid out.

  • We deduct tax at source where the law requires it, and give you the

certificate.

  • We will show you the Google Play figures your share was calculated from, on

request, once per quarter.

4.5 Your beloved stays yours. Every real name and identifying detail is removed or changed before the world is released publicly. The public theme keeps the art; it does not keep the person. Your named version, with your dedication as you wrote it, is delivered privately to you alone.

4.6 Who owns what. The maker retains ownership of the world as an artwork, including its art, code, type, and music — which is what makes 4.3 and 4.4 possible at all. You receive a perpetual, free, non-transferable licence to use your world in the app, plus the private named artifacts made for you. You retain everything in the story you sent; you grant us only the right to use it to build your world and the de-identified theme that follows, as described in 4.3 and 4.5.

4.7 Timelines. Worlds are made by hand by one person, and we will not promise a date we cannot keep. We tell you an honest estimate when we accept a commission, and we tell you if it slips.

4.8 What we will not build. We may decline a commission, refunding it in full, if what is asked for is hateful, depicts a real person in a way they have not agreed to, is unlawful, or is something the maker simply cannot do justice.

5. Refunds

  • Web content (story, Art Book): refundable within 7 days if you have not

downloaded anything.

  • App themes: handled by Google Play under Google's refund policy, not ours.
  • Commissions: refundable in full until work begins. Once building has

started, refundable in part, in proportion to what remains. Once delivered, not refundable — but if it is wrong, tell us, and we will keep working until it is right.

6. Fair use of your access

Your access is for you. Sharing an access link or redistributing the Art Book publicly is the one thing that would make this unsustainable, and we will close an account that does it. Downloads carry a quiet watermark identifying the buyer, which is how we would know.

7. What we do not promise

The app and site are provided as they are. We do not promise uninterrupted service, and we are not liable for indirect or consequential loss. Nothing here limits liability for fraud, death, or personal injury, or any liability that cannot lawfully be limited.

Our total liability for any claim is limited to what you paid us in the twelve months before it arose.

8. Changes

We may change these terms. If a change affects a commission already accepted, the terms in force when you commissioned it continue to apply to that commission.

9. Law

These terms are governed by the laws of India. The courts at JURISDICTION_CITY have exclusive jurisdiction. Nothing here removes any non-waivable right you have as a consumer where you live.
